Terms and conditions

These Terms and Conditions of Sale (hereinafter the “Terms”) govern the sale of products made on the website en.ametiscosmetics.com.

Any order placed on the website implies prior review and acceptance of these Terms. Clicking to confirm the order constitutes full and unconditional acceptance of these Terms.

Article 1 — Purpose

These Terms define the rights and obligations of the parties in connection with the online sale of the products offered by Ametis to consumers.

Article 2 — Products

The products offered are described and presented as accurately as possible. Photographs and descriptions are not contractually binding. The products comply with the French regulations in force applicable to cosmetic products.

Article 3 — Prices

Prices are shown in euros, all taxes included (VAT included), excluding delivery costs. Delivery costs are indicated to the customer before the order is confirmed. Ametis reserves the right to modify its prices at any time; products are invoiced on the basis of the rates in force at the time the order is registered.

Article 4 — Orders

Contractual information is confirmed by e-mail to the address provided by the customer. The computerised records kept by Ametis under reasonable security conditions are considered to be proof of the communications, orders and payments between the parties.

Article 5 — Payment

Payment is made online by bank card (via Stripe) or via PayPal, through secure payment methods. Ametis does not retain any banking data: such data is processed directly by the payment providers. The order is deemed effective once the payment centres have confirmed their authorisation.

Article 6 — Delivery

Products are delivered to the address provided by the customer when ordering, only within the geographic areas served by Ametis. Delivery times and costs are specified before the order is confirmed.

On receipt, the customer is invited to check the condition of the parcel and, in the event of damage or a missing item, to make reservations with the carrier and inform Ametis as soon as possible. In the event of delay or loss attributable to the carrier, Ametis will make every effort to locate the parcel or dispatch an identical replacement.

Article 7 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give any reason.

To exercise this right, the customer informs Ametis of their decision by an unambiguous statement (letter or e-mail to contact@ametiscosmetics.com), or by using the model form provided in the appendix. The products must be returned, no later than 14 days after this notification, complete, in their original packaging and in perfect resalable condition. Return shipping costs are borne by the customer.

Ametis will refund the customer all sums paid no later than 14 days after notification of the withdrawal. The refund may be deferred until the products have been recovered or until the customer has provided proof of their dispatch.

Exception (hygiene): in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for cosmetic products that have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection.

Article 8 — Legal guarantees

Independently of any commercial warranty, the consumer benefits from the following legal guarantees:

  • Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): products are guaranteed for two (2) years from delivery. In the event of a lack of conformity, the customer may request the repair or replacement of the product and, failing that, a price reduction or cancellation of the sale.
  • Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the customer may act within two years from the discovery of the defect.

Article 9 — Liability and force majeure

Ametis cannot be held liable for non-performance of the contract in the event of force majeure, as defined by the case law of the French courts (in particular transport blockages, natural disaster, fire, interruption of telecommunication networks, etc.). The affected party informs the other as soon as possible.

Article 10 — Intellectual property

All elements of the website (texts, images, trademarks, logos) are the exclusive property of Ametis or its partners. Any unauthorised reproduction or use is prohibited.

Article 11 — Personal data

The data collected is necessary for processing orders and managing the customer relationship. In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the customer has rights of access, rectification, erasure, objection and portability, which may be exercised at contact@ametiscosmetics.com. Article 12 — Mediation and disputes

These Terms are governed by French law. In the event of a dispute, the customer first contacts Ametis to seek an amicable solution.

In accordance with Articles L611-1 et seq. of the French Consumer Code, the consumer may use a consumer mediator free of charge. Ametis is a member of the following mediation service:

Article 13 — Miscellaneous

If any provision of these Terms is declared null and void, the remaining provisions retain their full force. The failure of Ametis to invoke a breach does not constitute a waiver of its right to invoke it at a later date.
